Terms of Service

Please read these terms carefully before using Indigenous Job Board Canada.

Effective Date: October 12, 2026 · Last Updated: October 12, 2026

These Terms of Service ("Terms") govern your access to and use of the Indigenous Job Board Canada website located at indigenousjobboardcanada.ca (the "Platform"), operated by Kohar Innovations Limited ("we", "us", or "our"), located at 15910 Fraser Highway, Surrey, BC V4N 0X9, Canada. These Terms form a binding agreement between you and us. Please also review our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform. You consent to receive communications from us electronically, including by email and through the Platform, and you agree that such electronic communications satisfy any legal requirement that communications be in writing.

Eligibility and Age

You must be at least 16 years of age to create an account or use the Platform. If you are under the age of majority in your province or territory, you may use the Platform only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. The Platform is not directed to children, and we do not knowingly collect information from children. By using the Platform, you represent that you meet these requirements.

User Accounts

To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

Role of the Platform

The Platform is an online venue that allows employers to publish job postings and allows job seekers to view those postings and express interest in them. We are not an employment agency, recruiter, staffing firm, or placement service, and we are not a party to any employment relationship, application, interview, offer, or contract that may result from use of the Platform. We do not screen, verify, endorse, or guarantee any employer, job seeker, job posting, application, resume, or communication, including the identity, qualifications, legitimacy, accuracy, or legality of any of them. Any dealings between employers and job seekers are solely between those parties, and you use the Platform and rely on any content at your own risk. We do not guarantee that any job posting will result in a hire, that any job seeker will obtain employment, or that any particular results will be achieved.

Job Postings

Employers may publish job postings on the Platform by purchasing a posting plan. All job postings must relate to genuine, lawful employment opportunities and must comply with all applicable Canadian laws, including human rights and employment standards legislation. We may, at our sole discretion and without notice, review, edit, refuse, suspend, or remove any job posting that we believe violates these Terms, is discriminatory, misleading, fraudulent, unlawful, or otherwise inappropriate. Removal of a posting for a violation does not entitle you to a refund. Job postings must accurately represent the position, compensation, and requirements of the role.

Employer Responsibilities and Warranties

Employers are solely responsible for their job postings, their hiring processes, and all employment decisions. Employers represent and warrant that their postings and hiring practices comply with all applicable federal, provincial, and territorial laws, including human rights legislation, employment standards, accessibility requirements, and privacy laws. Where an employer operates a program that gives preference to Indigenous applicants or other groups, the employer is solely responsible for ensuring that such a program is lawful (for example, as a bona fide special program or affirmative measure under applicable human rights law). Employers are independently responsible for any personal information they collect or receive about applicants, and for complying with applicable privacy law in respect of that information. Employers agree to indemnify us as set out in the Indemnification section below.

Job Seekers and Applications

When you apply to a job or express interest in a posting, the information you submit (which may include your resume and contact details) is provided to the relevant employer, who then independently controls and is responsible for the use of that information. We do not control how employers use information they receive. Exercise caution when interacting with employers and when sharing personal or financial information. Legitimate employers will not ask you to pay a fee to apply for or secure a position; treat any such request as a warning sign. We are not responsible for the conduct of any employer or for any fraudulent, deceptive, or unlawful posting or communication, and we encourage you to report any suspicious activity to us.

Acceptable Use

You agree not to misuse the Platform. You must not, among other things: (a) use any automated means (including bots, scrapers, crawlers, or data-mining tools) to access, copy, collect, or index the Platform or its content, including job postings or resumes; (b) collect, harvest, or store other users' personal information except as permitted by these Terms; (c) post or transmit unlawful, fraudulent, deceptive, discriminatory, defamatory, infringing, or harmful content; (d) post anything other than genuine job opportunities (for example, advertisements, solicitations, chain messages, or pay-to-apply schemes); (e) interfere with, disrupt, probe, or attempt to gain unauthorized access to the Platform, its systems, or its security features; (f) reverse engineer, decompile, or attempt to derive the source code or underlying structure of the Platform; or (g) use the Platform in any way that violates applicable law or these Terms. We may investigate and take any action we consider appropriate in response to suspected violations, including removing content and suspending or terminating accounts.

Payments, Subscriptions, and Refunds

Certain features require payment. Current plans, features, and prices are shown on the Platform at the time of purchase, are quoted in Canadian dollars, and are subject to applicable taxes. Payments are processed by our third-party payment processor; by making a purchase, you authorize the applicable charges. Some plans are offered on a subscription basis and renew automatically at the end of each billing period at the then-current rate, and your payment method on file will be charged, until you cancel. You may cancel at any time before the next renewal through your account's billing settings or by contacting us, and we will send renewal reminders before a renewal occurs. Cancellation stops future renewals but does not retroactively refund amounts already charged, and any posting credits or bundles are non-refundable once issued or used.

You may request a full refund of an initial purchase within 7 days of that purchase by contacting us at hello@indigenousjobboardcanada.ca; approved refunds are returned to the original payment method, typically within 5–10 business days. After 7 days, and in respect of renewals and used credits, payments are non-refundable except where required by applicable law. We may, at our sole discretion, provide additional refunds or credits as a goodwill gesture, without creating any obligation to do so in other cases. If you believe a charge is incorrect, please contact us first so we can resolve it; initiating a chargeback or payment dispute without contacting us may result in suspension of your account.

Intellectual Property

All content, design, graphics, logos, trademarks, software, and other materials on the Platform are the property of Kohar Innovations Limited or its licensors and are protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without our prior written consent. Content you submit to the Platform (such as job postings or profile information) remains yours, but you grant us a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, display, and distribute that content as needed to operate and promote the Platform.

Copyright Complaints

We respect intellectual property rights. If you believe that content on the Platform infringes your copyright, please send a written notice to hello@indigenousjobboardcanada.ca that identifies the copyrighted work, the allegedly infringing content and its location on the Platform, and your contact information, in accordance with Canada's notice-and-notice regime. We may forward notices to the relevant user and may remove or disable access to content we believe to be infringing.

Third-Party Services and Links

The Platform relies on third-party service providers and may contain links to, or allow applications to be completed on, third-party websites and services that we do not own or control. We are not responsible for the availability, content, products, services, or practices of any third party, and your use of any third-party service is governed by that third party's own terms and policies. Links and integrations do not constitute an endorsement.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Platform and all content and services are provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express, implied, statutory, or otherwise, including any implied warranties or conditions of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of harmful components, or that any content, employer, job seeker, or posting is accurate, lawful, legitimate, or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you; in that case, our warranties are limited to the minimum extent required by applicable law.

Limitation of Liability

To the maximum extent permitted by applicable law, Kohar Innovations Limited and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with the Platform or these Terms, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages. Our total aggregate liability for any and all claims arising from or related to the Platform or these Terms shall not exceed the greater of the total amount you paid to us in the 12 months preceding the event giving rise to the claim, or CAD $100. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, and where such law applies, our liability is limited to the greatest extent permitted by it.

Indemnification

You agree to indemnify, defend, and hold harmless Kohar Innovations Limited and its directors, officers, employees, and agents from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your content, job postings, applications, or communications; (c) your violation of these Terms or of any applicable law; (d) your hiring or employment practices or decisions; or (e) your infringement or violation of the rights of any third party. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate with us.

Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform will immediately cease. Any provisions of these Terms that by their nature should survive termination shall continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.

Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, power or internet failures, cyber-attacks, labour disputes, governmental actions, or the failure or unavailability of third-party services, networks, or infrastructure on which the Platform depends.

Dispute Resolution

If a dispute arises between you and us, you agree to first contact us at hello@indigenousjobboardcanada.ca and attempt to resolve the matter informally and in good faith. If the dispute is not resolved within 30 days, the parties agree to attempt to resolve it through confidential, non-binding mediation in British Columbia before commencing court proceedings. Subject to the Governing Law section below, any dispute not resolved informally or through mediation shall be brought in the courts of British Columbia. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief. This section does not limit any rights you may have that cannot be waived under the mandatory consumer-protection laws of your home province or territory.

Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, and the courts of British Columbia will have jurisdiction over any dispute, subject to the Dispute Resolution section. If you are a consumer resident in another Canadian province or territory, you may also benefit from mandatory protections of the law of that jurisdiction, and nothing in these Terms removes protections that cannot be waived under that law. For residents of Quebec, nothing in these Terms is intended to deprive you of the protection of the Consumer Protection Act or to require you to waive rights that cannot be waived under Quebec law.

General

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Platform and supersede any prior agreements. If any provision is found to be unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms without our prior written consent; we may assign or transfer these Terms, in whole or in part, without restriction. We may update or modify these Terms at any time; we will update the date above and, where changes are material, provide reasonable notice. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
